RE: DEEDS INTO AND FROM TRUSTS

A trust is not a legal entity. In order to convey or take title a trust must act by and through its trustee(s). Recent court decisions have addressed the consequences arising from deeds to or from trusts.

Texan Title Insurance Company will not insure any transaction where the named insured would be a trust — the insured must be the trustee of the trust. The trustee must be the grantee in the insuring deed.

Additionally, if your vesting deed shows a trust as grantee, please contact Underwriting so that curative steps can be taken.
